By accessing or using the services provided by GetUGC.io ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. We reserve the right to update these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
GetUGC.io provides user-generated content (UGC) creation services combining AI-generated and human-created video content for brands, agencies, and marketing teams. Services include content scripting, creator briefing, video production, editing, and delivery ("Services"). We do not guarantee any specific outcome, virality, or advertising performance from the content we produce.
Our Services are offered on a subscription basis. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are quoted in USD and are non-refundable except as expressly stated in our Refund Policy. We use third-party payment processors (Stripe) and do not store your payment card information. Subscription renewals are automatic unless cancelled before the end of the current billing period.
Refunds are evaluated on a case-by-case basis. If you are dissatisfied with delivered content, you must contact us within 7 days of delivery with specific feedback. We will work to resolve the issue through revisions. Refunds are not issued for change-of-mind cancellations after content production has commenced. Subscription cancellations take effect at the end of the current billing cycle; no partial refunds are issued for unused periods.
Upon full payment for the applicable subscription period, GetUGC.io assigns to you all rights, title, and interest in the final delivered content, including but not limited to usage across all digital platforms. You grant GetUGC.io a limited, non-exclusive licence to use delivered content as portfolio examples and in our own promotional materials unless you opt out in writing. We retain all rights to our proprietary workflows, AI systems, templates, and tooling.
You agree that content requested must not promote illegal activity, hate speech, harassment, explicit adult material, or any content that violates applicable laws or platform policies. GetUGC.io reserves the right to refuse production of any content we deem inappropriate or contrary to our values. You are solely responsible for ensuring delivered content complies with advertising standards and platform terms of service of wherever you publish it.
Both parties agree to keep confidential any non-public information shared during the engagement. This includes creative briefs, business strategies, unreleased products, and pricing structures. This obligation survives termination of the agreement for a period of two (2) years.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that content will achieve specific engagement, reach, or conversion results. Use of our Services is at your sole risk.
To the fullest extent permitted by law, GetUGC.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability for any claims under these Terms shall not exceed the total fees you paid to us in the three months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GetUGC.io is incorporated, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration before being escalated to litigation.
